Technical Issue with Blauwnet/NS Check in and Incident with NS Police

I am writing to you to request a CCTV footage from NS in Zutphen station, on Saturday May 3rd, between 19:24 and 19:39 on Spoor (Track) 2b, for the Blauwnet train from Zutphen to Enschede, departing at 19:39.

My mother and I both carefully checked in with our NS personal OV chipkaart, with a weekend vrij subscription on it at this track before we get on the train. But we later found out (by the police telling us we did not check in) that the cards had not worked. We tried to explain this to the police (three police officers), but they did not let us explain, told us we did not tell the truth, intimidated us by arrest, and fined us 61.99 EU each.

I would like to request a CCTV footage from that night as the proof that both my mother and I checked in and this is a technical issue either by the card or the check-in device. I do remember that I first tapped the card. Then my mother did. Then we both walked towards the waiting room to wait for the train to Enschede.

Please do this as soon as possible, before the CCTV data is erased. We need the proof to revoke the fine. I would like to do this within the 14-day period so that I avoid paying the fine.

As Daniel has stated, there are three different check-in points for different carriers in Zutphen. It can happen that you did check in, but with the wrong carrier. In that case, you did not have a correct travel permit for the carrier that you did not check in with. A conductor will write out a fine if this happens. You can check if this is the case via your Mijn NS account or via OV-chipcard by looking at your travel history. 

 

Regarding the requested camera footage: travellers cannot request this footage. When an incident has occurred and the footage is needed to solve this incident/to clarify what happened, then the police can request the camera footage.

Probably you have checked in at the pole of the wrong operator, there are three next to each other in Zutphen. For the ticket inspectors that will display on their device as no check in.

The train you took is operated by Arriva under the Blauwnet brand by the way, so should you want to file a complaint you should submit it via Arriva.nl

They checked in with a Weekend-Vrij subsciption. I would like to refer to this discussion in Dutch about bought-off travel rights. Why did these people get a fine?

The regional operators are in general a lot less lenient than NS staff when a check in is missing.

I think the regional operator’s can’t even see that you have Weekend Vrij, just NS Flex.

In that case, they should make a registration for a missing check-in and the system will decide if a correction is needed.
